Listed below are some of the more common situations resulting in either change of ownership or change to the owner status. The column on the right describes the document(s) required to effect the change. (There may be some differences in the requirements due to laws in particular jurisdictions.) All changes must be submitted in writing and mailed to:

SITUATION   A COPY OF THE FOLLOWING
DOCUMENTATION IS REQUIRED:
Sale of an Interest     Conveyance document filed in the county/parish in which the property is located.
Ownership Change Due to Divorce     Complete Divorce Decree including Settlement Agreement or recorded conveyance document, if applicable.
Trusts/Partnerships:      
Ownership by Trusts/Partnerships     Trust or Partnership Agreement and recorded conveyance document transfering the interest in the property to the Trust/Partnership.
Distribution from Trusts/Partnerships     Dissolution of Trust or Partnership, if applicable, and recorded conveyance documents to the beneficiaries.
Changes in Trustee     Instrument appointing successor trustee.
Joint Tenancy and One Dies     Death Certificate for the deceased joint tenant.
Estate Proceedings:      
Owner died with a Will (testate)
Probate proceedings conducted in the state where the property is located:
   
  1. Death Certificate
  2. Order Admitting Will to Probate
  3. Letters Testamentary
  4. Last Will and Testament
  5. Evidence of payment of debts and taxes
  6. Final Decree of Distribution or Judgment of Possession
Owner died with a Will (testate)
Probate proceedings conducted in a state other than the state where the property is located:
   
  1. All six documents listed directly above; plus
  2. Documentation of ancillary probate proceedings opened in all affected states, or Affidavit of Heirship.
Owner died without a Will (intestate)
(State laws of Descent and Distribution will apply as relevant)
   
  1. Death Certificate
  2. Letters of Administration
  3. Evidence of payment of debts and taxes
  4. Affidavit of Heirship
Bankruptcies:      
Chapter 11
(voluntary)
   
  1. Plan of Reorganization
  2. Order Confirming the Plan of Reorganization
Chapter 7
(involuntary)
   
  1. Order Naming Trustee of Bankruptcy Estate
  2. Recorded conveyance document, if applicable
  • All payees are required to provide either a SSN or TIN; otherwise Federal Law requires 31% withholding tax.
  • All documents effecting change of ownership must be filed on record in the county/parish where property is located.
